What Is UDRP?

UDRP (Uniform Domain-Name Dispute-Resolution Policy) was established by ICANN in 1999 as a faster, cheaper alternative to court for domain disputes. A trademark owner can file a complaint if they believe a domain was registered and used in bad faith. UDRP applies to all gTLDs, including .nyc.

The Three Elements of a UDRP Complaint

1. The domain is identical or confusingly similar to a trademark. 2. The registrant has no legitimate interest in the domain. 3. The domain was registered AND used in bad faith. All three must be proven. Fail on any one, and the complaint is denied.

When .NYC Owners Are at Risk

Registering trademarked business names like “cocacola.nyc.” Industry terms that overlap with brands. Domains registered primarily to sell to the trademark holder. Parked domains with ads related to a trademark’s industry.

How to Protect Yourself

Register domains matching your actual business. Use your domain actively with real content. Avoid trademarked terms — search USPTO (tmsearch.uspto.gov) first. Keep records of when and why you registered. Respond to complaints within the 20-day window — failing to respond almost guarantees losing the domain.

The UDRP Process

Complaint filed ($1,500 fee) → You’re notified → 20-day response period → Panel appointed → Decision in ~14 days → Implementation 10 business days after. Total: 45-60 days, much faster than litigation.

Legitimate Uses Are Protected

UDRP combats cybersquatting, not legitimate owners. Generic terms like “pizza.nyc” or “fitness.nyc” cannot be taken just because a similar business name exists. Browse safe, generic domains at primedomains.nyc.
